The Supreme Court of Arkansas recently removed “Issue 4” from this election’s ballot. “Issue 4” is a measure that would have capped compensation for “non-economic damages” to patients who have suffered injury due to medical malpractice, including residents of nursing homes. The Court removed the issue from the ballot because its language was deemed to difficult to understand by voters, but a similar proposal is already in the works for future elections.
